SERVER USE Personal accounts are to be used by the primary owner only. Personal account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads. Customers may however resell our packages. E-urohost reserves the right to refuse service and /or access to its servers to anyone. E-urohost do not allow any of the following content to be stored on its servers: Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation. Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of E-urohost. Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material. E-urohost reserves the right to suspend or cancel a customer's access to any or all services provided by E-urohost when E-urohost decides that the account has been inappropriately used or otherwise. USAGE POLICY High bandwidth usage: E-urohost offers a bandwidth usage of 2GB data transfer per month. In rare cases, E-urohost may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, E-urohost reserves the right to impose the High Resource User Policy for the consideration of all customers. HIGH RESOURCE USER POLICY Resources are defined as bandwidth and/or processor utilization. E-urohost may implement the following policy to its sole discretion: When a website is found to be monopolising the resources available E-urohost reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. PAYMENT POLICIES All accounts are set up on a prepay basis. Although E-urohost reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year, month, or 2 -years following the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given. In situations where the card number on file is declined E-urohost will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, E-urohost reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request. All payment is in UK sterling. PAYMENT OPTIONS In order to streamline our accounting procedures and keep costs down for the customer, E-urohost runs a limited number of payment options. Credit / Debit Cards: E-urohost accepts Mastercard, Visa, Visa electron, Switch and Solo Cheque Payment: This option is only available to customers who pay immediately. E-urohost cannot guarantee that a service will be provided until after any received cheques have been cleared. CANCELLATIONS E-urohost reserves the right to cancel the service at any time. If a customer contravenes E-urohost terms of service a refund will not be issued in the event of a cancellation. Customers may cancel their account at any time after the initial 12 month period. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation. Fees charged on a prepay basis are non-refundable. In addition some accounts incur set-up fees, these charges are also non-refundable. E-urohost will: Ensure that original content created by or for E-urohost and offered through the Service meets normal professional editorial and publishing standards. Keep any personal information given by the Client to E-urohost confidential and not pass it to third parties. Provide all services as detailed in the original offer and will promptly invoice the Client for any chargeable services that they have agreed to purchase. E-urohost reserves the right to exclude certain keywords/phrases if deemed inappropriate. E-urohost reserves the right to utilise position reports and site statistics for marketing purposes. E-urohost reserves the right to charge an administration fee of £10 on all service cancellations before contracted period expires. (Client may not terminate the ongoing service plan within the initial 12 month period.) All prices exclude VAT at 17.5% INDEMNIFICATION Customer agrees that it shall defend, indemnify, save and hold E-urohost harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against E-urohost, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless E-urohost against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with E-urohost' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from E-urohost' server. DISCLAIMER E-urohost will not be responsible for any damages your business may suffer. E-urohost makes no warranties of any kind, expressed or implied for services we provide. E-urohost disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by E-urohost and its employees. E-urohost reserves the right to revise its policies at any time. TRANSFER OF A DOMAIN NAME. On the Client's request E-urohost shall host an existing domain name owned by the Client always provided that the Client shall be solely responsible for the transfer of the Existing Domain Name to the E-urohost server on or after the commencement of any Agreement and for any fees payable to any third party in relation to such transfer. In order to effect the transfer the Client shall request his existing ISP or any other relevant third party:- (i)In the case of UK TLD's to modify the IPS Tag as required by E-urohost; and (ii)In the case of international TLD's to replace the name servers, admin, technical and billing contact with the relevant details received from E-urohost. E-urohost shall not be liable for any delay in such transfer. E-urohost reserves the right not to release the Domain Name or the Existing Domain Name for transfer out if the initial period (2 Years). If the Client wishes to transfer a domain name within the initial agreed period a transfer fee of £49 will be incurred. A fast track service is also available. RENEWAL OF REGISTRATION E-urohost will automatically renew the client's contract each year after the initial registration period unless the customer notifies E-urohost at least 30 days prior to the end of the agreement. In the case of UK TLD's renewal will be every 2 years charged at £20 +vat. In the case of international TLD's renewal will be every year charged at £20 +vat. In the case of .tv domains renewal is charged every year at the rate paid at initial registration.
